Terms of Service

These terms govern the online contracting of the NEXVYLIA web maintenance service (monthly subscription). By ticking the acceptance box and completing payment, you accept these terms. Save or print this page if you want to keep them.

1. Who provides the service

The service is provided by Matias Alvaro Quiriquino el Ashuh, sole trader, operating under the NEXVYLIA brand, with Spanish tax ID (NIF) 76586830G and address at Calle Reserva de San Bernabé, S/N, Bajo D, 11204 Algeciras (Cádiz), Spain. Contact: quoriquinomatias@gmail.com.

2. Scope

These terms apply to the contracting of the web maintenance service offered from the nexvylia.es customer portal, both for projects developed by NEXVYLIA and for external websites we have agreed to maintain after reviewing them. The exact monthly fee is always shown before you subscribe, on your project page.

3. What the service includes

Maintenance includes, within the scope of the fee you contract:

  • Technical updates of the website software (framework, dependencies and security patches).
  • Periodic backups and their restoration in the event of an incident.
  • Basic availability monitoring and fixing of malfunctions in what has already been delivered.
  • Support through the channels listed in the portal, with responses during business hours.
  • Reasonable small content changes (texts, images) when your fee includes them, as agreed in your quote or maintenance contract.

It does not include: development of new features, redesigns, content creation, marketing or SEO campaigns not contracted, or the costs of third-party services (domain, hosting, licences) unless expressly agreed. Such work is quoted separately.

4. Price and payment

The price is the monthly fee shown in your portal before subscribing, in euros. Unless stated otherwise, the amount shown at payment includes applicable VAT (21%), and each charge generates an invoice, available in your portal.

Payment is made by card through Stripe's secure gateway. You provide your card details directly to Stripe: they are never stored on our systems. The first charge takes place when you complete the subscription.

5. Duration and automatic renewal

The service is contracted on a monthly basis and renews automatically every month, charging the fee to the same card, until you cancel. There is no minimum commitment.

If the fee ever changes, we will notify you at least 30 days in advance; the new price will only apply from the next renewal and, if you disagree, you can cancel beforehand at no cost.

6. How to cancel

You can cancel at any time from your customer portal (subscription management) or by writing to the contact email. Cancellation takes effect at the end of the monthly period already paid: you keep the service until that day and you are not charged again. No partial refunds are given for the current month, except as provided for withdrawal in section 8.

7. Failed payments and suspension

If a renewal charge fails, Stripe will automatically retry over the following days and we will notify you so you can update your payment method. While the fee remains unpaid we may suspend the maintenance service (the website stays online, but without updates, backups or support). If non-payment continues for more than 30 days, we may terminate the subscription.

8. Right of withdrawal

If you contract as a consumer (a natural person acting outside their trade or profession), you have the right to withdraw within 14 calendar days of subscribing, without giving any reason, by writing to the contact email (any unequivocal statement is valid; no specific form is required).

By ticking the corresponding box during checkout you expressly request that the service starts immediately, without waiting for the withdrawal period to end, and you acknowledge that, once the service for the contracted period has been fully performed, you will have lost your right of withdrawal over it. Therefore, if you withdraw within those 14 days, you will be refunded the proportional part of the month not used; and if the service for the period has already been fully performed, the right of withdrawal will have been exhausted in accordance with article 103.a) of the Spanish Consumer Protection Act.

If you contract as a company or professional, the right of withdrawal does not apply; you can still cancel at any time as per section 6.

9. Data protection

Personal data linked to the subscription is processed in accordance with our privacy policy, available on this site's "Legal Notice, Privacy & Cookies" page. Where maintenance involves access to personal data for which your company is the controller (for example, your website's customers), that access is governed by the data processing agreement (art. 28 GDPR) signed with your quote or maintenance contract.

10. Warranty and liability

We provide the service with professional diligence and in accordance with the warranty rules applicable to digital services and content. We are not liable for failures caused by third parties beyond our control (hosting provider, payment gateway, integrated external services) or for damage arising from changes made to the maintained website by the customer or by unauthorised third parties.

Except in cases of wilful misconduct or gross negligence, and without limiting the rights the law grants to consumers, NEXVYLIA's total liability for the maintenance service is limited to the fees paid over the last 12 months.

11. Changes to these terms

We may update these terms to reflect legal or service changes. Relevant changes will be notified at least 30 days in advance and will apply from the next renewal; if you disagree, you can cancel before they take effect. The current version will always be published on this page.

12. Governing law and complaints

These terms are governed by Spanish law. For any dispute, if you contract as a consumer the courts of your place of residence will have jurisdiction; otherwise, the courts of Algeciras (Cádiz). Before it gets there, write to us: the vast majority of issues are resolved directly by email. You can also file a complaint with your local consumer office.
